South Carolina Air Permit Streamlining
South Carolina Department of Health and Environmental Control (SCDHEC) has made recent amendments to SC Regulation 61-62.1, Definitions and General Requirements, Section II – Permit Requirements. The regulations require a construction permit for stationary sources planning to construct, alter, or add to a source of air pollutants. Additionally, these regulations require an operating permit prior to placing a new or altered source into operation. The recent revisions clarify a number of expectations that were previously set by common practice or guidance. Some of the amendments include:

* Documenting the prerequisite to perform an air dispersion modeling analysis;
* Clarifying the allowable on-site activities prior to obtaining a construction permit;
* Guiding when permits may not be required;
* Requiring confirmation of as-built conditions after construction; and
* Updating construction permits application forms to aid in the implementation of the new requirements.

SCDHEC has implemented a transition period extending to October 1, 2007. During the transition period, one may still use the old construction permit applications. However, after October 1, 2007, SCDHEC will only accept applications submitted on the revised construction permit application forms.

In addition to the amendments made to SC Regulation 61-62.1, Definitions and General Requirements, Section II – Permit Requirements, Legislation (Section 44-1-165 or S.1263) was passed allowing SCDHEC to pilot an "Expedited Review" program. During this pilot program, one submitting a construction permit may request an expedited review. There is a fee associated with the request for an expedited review. The fee depends on the type of construction permit submitted but ranges from $1,500 to $25,000. For those not requesting an expedited review, the Department will review the application in accordance with the normal regulatory timeframe on a first come, first served basis.
